Privacy Policy

1. INTRODUCTION.

This Privacy Policy (the “Policy”) explains how SIMPLTech, Inc., a Delaware corporation (“Company”, “we”, “our”) collects, uses, and discloses personal information through our Platform.  By using or accessing the Services in any manner, you acknowledge that you accept the practices and policies outlined in this Policy, and you hereby consent that we will collect, use, and share your personal information in the following ways.  Any capitalized terms that are not defined in this Policy are defined in our Terms of Service (https://www.simpltech.ai/terms-of-service).

2. INFORMATION COLLECTED AND HOW WE USE IT. 

As explained further in this section, you will have the opportunity to provide us with certain personal information. In addition, we may collect certain personal information automatically through your use of the Services. We will use this information to provide you with the functionality of our Services, to improve our Services, and to provide you with information about our Services. The rest of this section provides a more detailed explanation of the personal information we collect and how we use that personal information.​​​​

2.1. Voluntarily Disclosed Information.

2.1.1. Account Creation.

In order to create your Account on the Platform, you will need to provide your email address. You may also be required to choose a password. As part of the Account creation process, you may also be able to provide us with access to additional personal information and data through integrations with third-party services like Facebook or Google.

2.1.2. Service Selection.

Depending on the nature of the Services you request, including the Automations you create, you may provide additional information, including, but not limited to, your home address and other addresses associated with you and your phone number. Such additional information may also include Communications Account Content or other contents available via your device that you allow the Platform to access and that are stored temporarily for the purpose of providing you with the Automations you create (“Temporary Inputs”). To the extent the Inputs related to the Automations you create as part of the Services include any personal information, such personal information may also be incorporated into the Outputs.

2.1.3. Posts and Comments.

You may have the option to post content and text to the Platform, and to comment on content and text that other users post to the Platform (collectively, “User Content”). You may also have the option to send messages directly to other users through the Platform.

2.1.4. Company Communications.

We may communicate with you if you’ve provided us the means to do so. For example, if you’ve given us your email address, we may send you promotional email offers or email you about your Account and your use of the Platform.

2.1.5. Marketing Recipient.

If you are interested in learning more about our Services, you may subscribe to promotional emails from us via the Platform. In order to subscribe, you will be asked to provide your name and email address. If you are not otherwise a user of our Platform, we will only use your personal information to send marketing communications relating to products and services that we offer.

2.2. Automatically Collected Information.

2.2.1. Browser & Device Information.

Whenever you interact with the Services, we may automatically receive and record information on our server logs from your browser or device, which may include your IP address, geolocation data, device identification, “cookie” information, the type of device you’re using to access the Services, the amount of time spent on the Services, and the page or feature you requested. “Cookies” are identifiers we transfer to your browser or device that allow us to recognize your browser or device and tell us how and when pages and features in the Services are visited and by how many people.  You may be able to change the preferences on your browser or device to prevent or limit your device’s acceptance of cookies, but this may prevent you from taking advantage of some of our features. We use the data we automatically collect from you to customize content for you that we think you might like, based on your usage patterns.  We may also use it to improve the Services – for example, this data can tell us how often users use a particular feature of the Services, and we can use that knowledge to make the Services interesting to as many users as possible.

2.2.2. Emails.

We may receive a confirmation when you open an email from us.

3. DISCLOSURE OF INFORMATION.

We may disclose your personal information to the categories of third parties identified in this section.

3.1. Personnel and Third Party Service Providers.

We employ personnel and engage other companies and people to perform tasks on our behalf and need to share your personal information with them to provide products or services to you. For example, we may use a third party payment processor to process payments on our behalf.

3.2. Other Users.

Please note that if you submit any personal information or User Content to a portion of the Platform that is accessible by other users, which may include, without limitation, an online forum or comment section, those users will be able to see that personal information and User Content. Accordingly, only include personal information in such submissions that you are comfortable sharing with other users and for which you have all necessary consents and/or licenses, as the case may be, to access, use and share any such information.

3.3. Third Party Applications.

If you use third party applications (the “Third Party Apps”) within the Platform or otherwise in connection with Automations, the Company will allow the providers of those Third Party Apps (the “Third Party Providers”) to access or use your Inputs, personal information and User Content as required for the interoperation of the Third Party Apps and the Platform. Any Third Party Provider’s use of your Inputs, personal information and User Content is subject to the applicable agreement between you and the Third Party Provider. The Company is not responsible for any access to or use of your Inputs, personal information or User Content by Third Party Providers. You are solely responsible for the decision to permit any Third Party Provider to use your Inputs, personal information or User Content.

3.4. Analytics Services.

We may use analytics service providers for data analytics to help us improve the Services and our users’ experience, including by monitoring metrics such as total number of visitors, traffic and demographic patterns.

3.5. Anonymous Information.

We may de-identify your personal information so that you are not identified as an individual, and share that information with third parties. We may also provide aggregate usage information to third parties (or allow these third parties to collect aggregate information of activity on our Services), who may use that information to understand how often and in what ways people use our Services, so that they, too, can provide our users with an optimal online experience.

3.6. Business Transfers.

If we (or our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, personal information could be one of the assets transferred to or acquired by a third party.

3.7. Legal Compliance.

We reserve the right to access, read, preserve, and disclose any information that we believe is necessary to comply with governmental requests, law enforcement or court orders, or enforce or apply our Terms of Service and other agreements.

3.8. Google API Disclosure.

NoteTech's use and transfer of information received from Google APIs to any other app will adhere to Google API Services User Data Policy, including the Limited Use requirements. Google Workspace APIs are not used to
develop, improve, or train generalized AI and/or ML models.

4. SECURITY

We use commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information. In addition, we enter into terms of use or other contracts with all of our third party service providers that require reasonable precautions be taken against unauthorized uses of your personal information. We cannot, however, ensure or warrant that these precautions will always be successful or that your personal information on the Services may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. We are not responsible to our users or to any third party due to any such loss, misuse, or alteration.

5. MODIFICATION, DELETION & RETENTION OF INFORMATION.

Through your Account settings or through your Management Platform, if applicable, you may access, edit and delete certain of your Account-related information, Outputs and associated metadata. Please understand, however, that it may be impossible to delete this information completely, due to backups, records of deletions and training model retention. In addition, we may deny a request if (i) the denial is necessary for us to comply with applicable law, or (ii) the request pertains to content that you posted on a publicly available portion of the Services and that cannot be deleted without impacting the Services experience for other users. You may not request the removal of de-identified, anonymous, or aggregate data from our databases. In addition, Temporary Inputs may not be deleted due to their ephemeral nature.

Subject to your right to request deletion of your personal information, we will retain your personal information as long as needed for your use of the Services, your approved receipt of marketing communications from us, our compliance with legal obligations, and to protect our or others’ interests.

6. HOW WE RESPOND TO DO NOT TRACK SIGNALS.

We do not track you or collect your information across third party websites or online services. Thus, we do not receive Do-Not-Track signals, or other similar signals. To the extent that we do receive any such signals, we will not comply with them as it is not an aspect of the functionality of the Services.

7. AGE POLICY.

We do not intend that the Platform be used by anyone under 13 years old and we do not knowingly collect or solicit information from anyone under the age of 13. If we learn or have reason to suspect that that an individual who has created an Account is under 13 years of age, we will promptly revoke such individual’s access to the Platform and delete any personally identifiable information submitted by that individual as quickly as possible. If you are 13 or older, but under 18, you must have permission from your parent or guardian to use our Services.

8. CHANGES TO POLICY.

We’re constantly trying to improve the Services, so we may need to change this Policy from time to time as well. The date of the last modification will be posted at the beginning of this Policy. It is your responsibility to check from time to time for updates. By continuing to access or use the Services, you are indicating that you agree to be bound by the modified Policy.
